I am not a lawyer by any means and wading through all the legalese is time
consuming, but what I have come up with is as follows:
1. Rep. Floyd Spence of SC filed a bill along with other sponsors in the
House Armed Services Comm. for the regular DOD appropriations for 2001.
2. It is listed as H4205. It has been working its way through the House for
a while and has now passed.
3. Within H4205 is Title III, Subtitle G, Sec. 361 et al. To read it for
yourself go to www.congress.org and click legislation, enter H4205 and look
through it. The easiest version to look through is version 2.
4. These sections allow and require that the Secretary of Defense or
designee provide a list of all property that was once owned by the DOD,
which was EITHER on the SME list (Significant Military Equipment, as almost
all trucks, jeeps, radios, etc are) or the DRMO demil list past or present.
The authority is granted under this law to require that all such items in
private hands either be returned to the DRMO for dimilling again or in the
1st place or be demilled where it is and be inspected by a government agent
and certified as being destroyed. Further it empowers the government to
invalidate any prior legitimate sale of such items, provide the owner with
an amount of compensation deemed reasonable by the DOD, confiscate the item
and demil it. There is more to this and one should read it for themselves
but this is a short synopsis.
5. After being passed by the House last week it was forwarded to the Senate
for ratification. The Senate amended the bill heavily and it is now listed
as S2550. The language we fear is apparently as far as I can see removed.
However it is not over.
6. The House refused to agree to the Senate version on Friday and the bill
is now going into a House Senate Conference Comm. to come up with a version
both can agree on prior to being sent to the President to be signed into
LAW.
7. Due to the need for the money sections of the bill, it is on the FAST
track.
Sorry for the long post but this whole thing is the most dangerous thing I
have seen come along in my 30 years of Historic Military Vehicle Collecting
and is an outrage. I have already contacted my Senators about this and I
would say that others should do what they think is best also. I was
informed that this is a response by certain paranoid legislators who are
attempting to get at what they believe is the militia danger. Rubbish.
