There is protection for National Guard & Reserve members. It is the Federal
Soldiers & Sailors Civil Relief Act.

If a business removed , demoted or fired an employee based on military
obligations the person files with the military system. If it is sustained
the employee will be rehired with back pay including Overtime, full
seniority & benefits. There also is a severe monetary penalty for the
employer.

If Pep Boys did indeed screw up & fire a reservist, they should & will get
hung.

I served 43 years, 3 Regular Army, 30 NJ National Guard & 10 Army Reserve.
During that career, I served on several hearing boards, prior to the
employee filing with the relief act.

Pep Boys is not the first firm to penalize employees. Usually it is a low
or middle level manager that never thinks before they act. After the
company pays for the stupidity, the manager is usually long gone, &
deservedly so.
