I had problems with the sale of my M16 halftrack.
The guy who came to see it and gave a deposit "subject to assurances as to
the condition of the engine" ( he wrote it on the reciept) proved to be a
real nightmare. It hadnt run for 5 years and when my friend got to look at
to get it ready to move it he identified there were valve problems etc and
we decided to hand the bloke his money back as we he woudlnt have been
happy. But no that wasnt good enough for this nightmare buyer - he sent the
check back uncashed, demanded proffesssional engineers inspection etc etc
plus a retention of a large % of the money subject to the engine being
proffessionally rebuilt at his direction. This saga went on and on, with
him threatening to sue me for his "considerable expenses" - he saw it once
and made dozens of irritating phone calls - and demanded"compensation for
his dissapointment". He did finally accept his cheque back ( if i could be
compensated for every dissapointment I had in life I would be a very rich
man) he claimed I had no right to pull out of the deal as we had a
"contract" - this was rich coming from an estate agent - in the UK they mess
clients around for a living and have gazumping off to an art form.It was a
private sale and there was no contract.
All in all I am so glad I pulled out as apart from his attitude, he would
have been constantly finding fault with something over 60 years old and I
was sorry enough to see the M16 go , but would have been sorry to see it go
to such a bad home.
Ironically, a MILWEB customer mentioned to me he had had a run in with the
same guy and had refused to deal with him.
But when I sold the Stuart, no problems, the buyer sent his mechanics down
the day before to get it running and everything packed inside so it was
ready to load when the truck came.
Of course - the wider question is - who assumes liability for NOS parts? the
original manufaturer? the re-seller? the end user? How would one prove how
they had been distributed - where does the liability stop?
