Surplus Condition Question

This question is MV related because some folks carry canteens in their MVs
and the vendor also sells vehicle parts...

This might sound silly but if you have a spare minute, please look at the 1
quart GI canteen caps in the picture linked below. Yes, the cap on the right
has a broken strap. These caps are being sold as "NEW" by a vendor on the
internet. Do they look new to you?

I disagree with the condition but maybe I was expecting too much? I won't
get into the fact that I only received half the quantity I ordered and paid
for, or that I had to ask about shipping 2 weeks after they were ordered and
paid for but not received.

List input appreciated as what should be a small thing has me fairly pissed.
