Two weeks ago we went to the shop to look at the completed engine--and
the bill came to $1668. I about fell over. My mechanic (not connected
with this shop) told me he that it was going to come in more like $1000,
or $1100 but that would be with new pistons--as good or better than new.
He was expecting a $1000-$1100 bill.
Since then I've spoken with owner of the store/machine shop. He is
claiming their salesman told my mechanic $1200 minimum to start and it
went up from there--while my mechanic says no one ever said anything
over $1200.
The store is claiming the engine is an "odd manufacture" and required
special order parts from one company--basically a Volvo supplier. The
engine is a F-V 1379 (?) with 94 BHP. Is this that odd of an engine?
Are parts non-standard and hard to find/expensive? What vehicles was
this engine used in? What are some other suppliers for parts? This
place is a AAA Auto Parts dealer whom (up until recently) my mechanic
used regularly with success.
The owner is standing behind his salesman despite my mechanic claiming
the salesman is lying. I spoke with the mechanic yesterday--and
reminded him of a couple things--first--that there is no written
agreement signed by anyone regarding this--and if he is expecting my to
pay $1668 he needs to remember that oral contracts over $500 are not
enforceable in court. Also, there is a mirror reflection clause in
contract law, thatsays both sides must be the same in the start as the
end on both sides for it to be enforceable. Oral agreements are
acceptable as long as both sides agree to abide by them if over $500 but
not enforceable in common law. The Uniform Commercial Code does not
apply to oral contracts.
Basically I am in a difficult spot--they've got $500 and my engine. The
mechanic was going to go talk to the owner yesterday. (He didn't
particularly like talking to me). I told my mechanic to try and strike
a deal for $1400 and get it out of there--or to have them pull any parts
still wrapped in original packages out to get the cost down and get it
out of there. Anyone have any further suggestions?
I am curious about the rarity of the engine--and any additional
ammunition any of you can provide me--or dealing in similar situations
anyone has had. Basically this is derailing my schedule and budget and
I would like to get it resolved, while to awarding themfor bad business
practise s. Of the $1668, $175 was labor and the rest was parts if that
says anything.....
