At the state level there is strict enforcement because they want to get their sales taxes.
Here in California I know of a case where exempt diesel for farm use was "accidentally"
getting into the owners truck. He got caught in a surprise inspection -- the truck was
impounded during the investigation and there was a heavy, heavy fine plus an allowance for
back taxes based on the State's generous estimate of how much he must have used.
