ATF LIFTS BAN ON MILITARY HARDWARE
EAA officials Oct. 13 learned that the U.S. Department of the Treasury's
Bureau of Alcohol, Tobacco and Firearms has lifted many of its restrictions
on the importation of surplus foreign military equipment, including subsonic
ex-military aircraft.
ATF Firearms, Explosives and Arson Services Division Chief Philip Horbert
said the agency will ease provisions of the Arms Export Control Act of 1976
that prohibited U.S. aviators from owning all but a few noncombatant types
of foreign military surplus aircraft.
The new guidance allows importation of any type of ex-military aircraft -
including jets - that are incapable of reaching the Mach 1, the speed of
sound.
Under Title 27, Volume 1, Part 47 of the U.S. Code of Federal Regulations,
importing everything from airplanes and rockets to firearms and uniforms
processing was prohibited. Citizens could purchase "demilitarized"
ex-military equipment, provided they had an approved Form 6 application ...a
lengthy bureaucratic process with a considerable backlog at ATF
headquarters.
According to Horbert, the ATF will review all outstanding Form 6
applications at his office and approve them simultaneously.
The only military aircraft that will continue to be banned from import are
foreign-built supersonic planes, and aircraft built by U.S. manufacturers
for overseas sale.
Under the old provisions of the Arms Export Control Act, only foreign
surplus military cargo, trainer, utility, observation and liaison aircraft
were permitted for import.
EAA Warbirds of America President Jack Harrington was notified of the rule
change during a conversation with Horbert Oct. 13. Information on formal ATF
guidance will be released on the EAA web site as soon as it's received.
