In New Jersey the law is pretty much the same - no passengers outside of
the passenger compartment. Even that old Subaru pick up truck with the
seats and belts in the back was not approved, from what I've been told.
The bed of a truck, as designed for cargo is not considered a passenger
compartment, no matter how modified in New Jersey. This was what I was
told from the DMV state office. Perhaps someone else has "better"
information, but to my knowledge this is correct.
PS: Most insurance companies specifically prohibit riders in the back of
the deuce, even firmly implanted on the troop seats. In fact, when I had
planned to use my deuce for a commercial venture, which involved
transporting passengers, the insurance companies ALL told me the same
thing - NO WAY! I could install all the seat belts I wanted and it would
not change their decision. If I was fully insured and got in an accident
with a passenger in the bed, I would not be covered for liability.
Again, having said the above, I, as well as many, many of my fellow
collectors have driven in parades with passengers in the bed. I would
not attempt the doing the same on a public highway in general traffic.
