Check your state rules on sales tax. Most states don't require you to
collect sales tax on used merchandise/property. After all, it's already
been collected once.

Not all states, but most that I've dealt with.

Here we are again, in an area where the laws vary hugely from state to state

(just like motor vehicle laws).

In Maryland, up until fairly recently, you -DID- need to collect sales tax
for a yard sale. There is now an exception for "casual and isolated sales
... of a seller's own household goods". The only reason the exception
exists is because enough voters wrote enough letters to their delegates
outraged at having the Comptroller's police shut down their neighborhood
yard sale. Yes, here in Maryland the state Comptroller (tax collector) has
his own police department. They have paid numerous visits to craft shows
etc. and required a $500 tax deposit, paid in CASH RIGHT NOW, from sellers
from out of state who don't have a Maryland Sales and Use Tax Account.

It is not relevant to Maryland, for sales tax purposes, if it is a hobby or
not as far as the IRS is concerned. If you sell it you must get a sales and
use tax permit, collect sales tax, and file a sales and use tax return when
you remit to the state.

Generally speaking, they don't bother an event where people are selling
things until one of two things happens:
- the event looks like it's large enough to be worth it
- someone says something to them about tax evasion (this includes angry
neighbors).

Again, Maryland. YMMV.
